Terms of Service

Last updated · English version

These terms govern use of Smashmaker, an independently operated platform for creating, sharing and playing Smash or Pass decks. By using the service, you agree to these terms to the extent permitted by applicable law.

1. Using the service

Use Smashmaker only where you meet applicable age and consent requirements and can lawfully agree to these terms. If you need permission from a parent or guardian, obtain it before using the service.

Decks and votes are for entertainment. They do not establish facts about a person, their consent, their value or their endorsement of the service. Use the service respectfully and do not use it to harass or target people.

2. Accounts and guest sessions

Keep your login credentials secure and provide accurate information where required for account operation. You are responsible for activity you authorize through your account. Tell us if you suspect unauthorized access.

Guest activity depends on a guest identity stored through your browser and authentication session. Losing that identity, clearing browser storage or using another device can prevent recovery of guest content. Registering or linking an account can make ongoing access more reliable.

3. Content you submit

You retain the rights you have in your submitted text, images and decks. You must have the rights, permissions or other lawful basis needed to upload and share them, including applicable copyright, trademark, image and privacy rights.

You grant Smashmaker the non-exclusive permission needed to host, store, reproduce, resize, process, moderate and display that content, and to share it according to the visibility you select. Publicly shared content can be discovered, viewed and played by others. This permission lasts while necessary to provide the requested service, subject to deletion, backups and legal obligations described in the Privacy Policy.

Use a public username and profile image that you are comfortable displaying. Public, unlisted and private visibility have different effects. Anyone with an unlisted link can access that content; sharing a link can therefore expand its audience.

4. Prohibited behavior

Do not submit unlawful content, sexual exploitation, sexualized depictions of minors, full nudity, explicit sexual imagery, threats, harassment, hateful abuse, private information about others, or material that infringes their rights. Content involving minors must never place them in an inappropriate context.

Do not distribute malware, impersonate others, bypass access controls, interfere with the service, automate abusive traffic, manipulate activity statistics or access private content without permission. Do not use the service to promote unlawful drug use or excessive violence.

5. Moderation and reports

We use automated tools and administrative review to enforce content rules. Submitted text and images may be processed by service providers for moderation and image preparation. Automated decisions can be mistaken; you may contact us to contest a restriction or request review.

We may remove or restrict content or access where reasonably necessary to enforce these terms, address legal obligations, prevent abuse or protect the service and its users. Where required by law, we provide reasons and an opportunity to challenge the decision.

Report unlawful or infringing content to contact@smashmaker.cards. Include the relevant URL, the reason for the report, your relationship to any affected rights and a way to contact you. Share only information needed to assess the report.

6. Third-party content and research estimates

Third-party names, characters, images and trademarks remain subject to their owners’ rights. Their appearance in a deck does not imply sponsorship, affiliation or endorsement. Links and externally hosted material are subject to the third party’s own terms and policies.

Search-demand reports and SEO suggestions are research aids. Google Ads and imported Keyword Planner numbers are estimates, may group similar queries, and can omit information. Search Console impressions measure site visibility; autocomplete suggestions do not establish search volume. Research does not guarantee traffic, rankings or commercial results.

7. Availability and responsibility

We work to provide a usable service, but features, compatibility and availability may change or be interrupted. Keep independent copies of content you need. We do not guarantee that all content is accurate, lawful, continuously available or free of technical problems.

To the extent permitted by applicable law, the service is provided as available without additional guarantees. Nothing in these terms excludes mandatory consumer rights or liability that cannot lawfully be excluded, including liability for fraud, deliberate misconduct or other protected circumstances.

8. Leaving the service and changes to these terms

You can stop using the service at any time, remove content through available controls, and request account closure at privacy@smashmaker.cards. Information handling following closure is explained in the Privacy Policy.

We may update these terms as the service or applicable requirements change. The updated version will carry a revised date. Where required, material changes will be notified before they take effect or will require renewed agreement.

9. Contact and applicable rights

For service questions, disputes or legal notices, contact Smashmaker at contact@smashmaker.cards. Send privacy and account-deletion requests to privacy@smashmaker.cards. Please describe the issue and include relevant links so we can investigate.

These terms do not remove protections provided by mandatory law in your jurisdiction or restrict your right to contact a competent authority or court. Where a provision cannot be enforced, the remaining terms continue to apply to the extent permitted by law.
